The Mountains Win Again

Enjoy the tranquilly of a small mountain town in the comfort and silence of this fully equipped townhouse .5 mile from downtown Carbondale, Art District with views of Mt. Sopris. Within a short walk or bike will enjoy high end restaurants, breweries, and distillers. Come home to a quiet neighborhood, with a beautiful back yard and garden to relax.

This condo is the end unit with a nice big back yard and patio. There are two bedrooms with queen beds and a shared bathroom upstairs. There is a large den with a large sectional pullout queen couch with a full bathroom downstairs with an oversized tub. There is a deck upstairs with a grill and views of Mt. Sopris from your dining table. There is a two car garage with an area setup as a gym.

Keep in mind the easiest way to communicate with us is via Airbnb messaging system; please use this message system, and we will respond promptly. We are often in low cellphone coverage areas, and phone calls and texts will not reach us quickly. Our goal is to keep our cabin well maintained and secure for all of our Guests. We want you to enjoy your visit; hopefully, these house rules will help you enjoy and understand our property. As a guest, I agree to the following terms and conditions:
TERMS AND CONDITIONS

1. The premises are to be used only as a private vacation residence for registered Guest (s). The Guest (s) will provide the Owner with a complete list of all occupants of the premises. The Tenant will not allow occupancy in the condo more than that agreed upon in reservation. No Parties or group gatherings, other than registered Guest (s), shall occur. The maximum number of Guest (s) five (5) persons. 2. The person booking the reservation must be over the age of 18 and be an occupant of the unit during the entire reserved period. 3. Smoking: 100% Smoke-Free home. Guest (s) or Guest (s) of Guests cannot smoke anywhere on the property ground inside our condo or outside. We do not rent to smokers. Please do not rent if you are a smoker, even if you plan on smoking off the property. Any sign of smoking will result in a $500 extra cleaning fee will be charged. 4. Storage of Food Items: Guests to maintain a clean environment outside the cabin by not leaving food items out. Food items should be kept inside to prevent attraction of bears. Please keep doors locked at night to prevent any possibility of a bear intruding into the cabin.

5. Check-­In/Check-­Out: Check-in instructions will be provided to you via Airbnb messages before your arrival. Please bring printed check-in instructions with you the check-in information with you. Check-in is at 4 PM MST. Check-out time is 10 AM. MST. If you check out later than 10 AM, you will be charged twice the nightly rate for each additional night. Check-out upon departure, put all garbage in plastic garbage bags then in the cans outside, wash any dishes you used. Please leave the bedding on the bed. 6. Early check-­in and late check­-out requests are available for and an additional fee may be added based upon availability. These requests must be made 24 hours in advance. Please message in writing. 7. If the cabin is left excessively dirty, we will charge an added check-out cleaning fee.

8. Please use beach towels for the hot tub and the bath towels to remain inside the unit. 9. Any issues with the cabin need to be brought to our attention right away during your stay so that we can make it right. We will only be able to address any issues with registered guests of the unit.

10. Lost and Found Items: We are not responsible for lost items or damaged items. In addition to shipping and handling charges to return items left behind, we charge a $25 fee to look for and retrieve lost items.

11. Cancellations: Our cancellation policy follows Airbnb's "strict cancellation policy" please refer to Airbnb site in addition to this policy; we do not provide refunds for unforeseen developments of weather including rain or snow storms. We strongly suggest that you purchase private travel insurance.12. No Daily Maid Service: We provide bed linens and towels. There is no daily housekeeping. For reservations 14 days or greater a mid-­stay clean is required for $125. A starter supply of bath soap, toilet tissue, and garbage liners will be provided; however, the Guest will need to purchase further supplies as they will not be replenished during your stay.

13. Guests Liability: Guests agree to accept liability for any damages caused to the property by guests or Guest's guests, including but not limited to landscaping, misuse of appliances, and equipment furnished. If damages are more than the damage waiver, the Guest agrees to reimburse owners for costs incurred to repair/replace damaged items. The rental is equipped for housekeeping with dishes, cookware, silverware, and glasses. Please do not remove any furnishings, equipment, or items from the unit, including any linen, dishes or other items from the unit.

14. Guest understand that the loft is not safe for sleeping and is not allowed to be used by guests. It is only for storage for supplies and for owner or manager to access.

15. We do not allow open flames inside or out! We are in high wildfire risk area in the summers.

16.Guest understands that there is no guaranty that properties adjacent to the cabin will be free from disturbances, including but not limited to noise or inconvenience from construction, traffic, or other guests or neighbors, and any such disturbance shall not constitute a breach of this Agreement or give Guest any right to any refund or rental adjustment. There are very few neighbors and none very close so this would be a very strange occurrence.

17. Illegal and or Disruptive Activity: We reserve the right to remove any individual from the premises for any illegal or disruptive behavior on the premises. We reserve sole discretion in determining if a guest should be removed from the premises for illegal and or disruptive behavior. No arrest or conviction is necessary for us to remove an individual from the property. If an individual is removed from the property for such activity, no refund will be issued for money paid. Quiet hours are from 9:00 PM to 8:00 AM. We ask that everyone respect each other's privacy and quiet enjoyment by keeping music, televisions, etc. at a moderate level at all times. 15. Guest understands that there is no guaranty that properties adjacent to the cabin will be free from disturbances, including but not limited to noise or inconvenience from construction, traffic, or other guests or neighbors, and any such disturbance shall not constitute a breach of this Agreement or give Guest any right to any refund or rental adjustment.

18. Hold Harmless: Owners do not assume any liability for any loss, damage, or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity, or plumbing. We will use its best efforts to ensure that all equipment within the unit is in good working order, although neither Manager nor Owner guarantees that any equipment will not break down during your stay. In the event of a breakdown, we will use commercially reasonable efforts to remedy the situation as soon as possible after notification of the breakdown. Additionally, such a breakdown does not constitute a breach of this Agreement or give Guest any right to any refund or rental adjustments for any such mechanical failure. Nor will we accept liability for any loss or damage caused by weather conditions, natural disasters, or other reasons beyond its control.

19. Internet: We do not guarantee internet and cable connectivity. If there happens to be an issue with the service it will be due to the provider and a tower being down and they promptly repair. The guest may contact the manager or owner to notify them of any issues. Guest understands that no refunds will be given for Internet connectivity issues or lack of service.

20. Walkways: The Guest is fully aware that the walkways can be dangerous, that they can be slippery when wet, and that injury is likely to occur to anyone not using caution. Guests should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of walkways and stairs into the cabin.

21. Additional Terms and Conditions: The Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges actual Owners from any and all claims, demands, and causes of action by reason of injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold actual Owners free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this Agreement, their Principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.

22. Travel Insurance: We strongly recommend purchasing travel insurance. Some providers will include trip cancellation and interruption services, as well as emergency assistance and travel services, covering financial losses.

23. Natural Disaster Policy: We not offer refunds or reschedule bookings due to any natural disaster activity. If you are concerned about the possible interruption, cancelation or delayed travel due to natural activates out of our control, you are strongly encouraged to purchase travel insurance at the time of booking.
